EXTENDED FAMILY MEMEBERS EUROPEAN APPLICATIONS UNDER EEA LAW POSSIBLE AND VALID ROUTE FOR OVERSTAYERS

Many people are not aware of this category which provides a right to the European National to sponsor their family members or extended family members. The examples for family members are parents, spouses, siblings. The categories fall under the extended family members can be cousins, uncles and aunts. The main factor is to prove the genuineness of the relationship.

The criteria to be met is that the European National has to be settled in the UK. He or She may be working, self-employed or a student. By showing that they are proving that they are duly exercising free movement rights as a national of one of the European Countries. The EEA must be contributing to the economy and the society of the UK. Another limb of the criteria is that the EEA National has been providing financial help to this family member previously which really conforms the genuineness of sponsorship and non-European nationals’ dependency on an EEA National. No need to say that if the Non-European national is dependent on the EEA National then he would be residing with the EEA National.

There are few and noticeable more factors to be aware of to fulfil the criteria to make this application. Many of the people are meeting the above said criteria but they have no idea of their rights to claim permission to stay here in the UK. If such application is approved by the Home Office then the applicant may be granted 5 years visa and after these 5 years by proving the continuity of the above said criteria the Non-European may be granted Indefinite Leave to Remain in the UK.
